LIMITATION OF LIABILITY: CATAPULT shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if CATAPULT has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. When placing an order with CATAPULT the customer agrees to the terms or our limited liability, and return and refund policies. CATAPULT's limit of liability is the purchase price of the stand or banner purchased. The customer agrees to hold CATAPULT harmless for any other costs other than those associated with the direct purchase price of the stand or banner purchased. CATAPULT does not refund shipping charges. Customers are responsible for all shipping charges of products. CATAPULT is not responsible for products damaged in shipping, mishandling or redirected products, or any other circumstances out of CATAPULT's control. A stand or banner may be either refunded or repaired at CATAPULT's discretion if it is within the return policy time frame.
In no event shall CATAPULT's liability to Customer's for any claims under this Agreement exceed the amount paid by Customer to CATAPULT during the three (3) months preceding the occurrence of the event's giving rise to Customer's claim.
When it comes to shipping delays we follow FedEx rules and Exclusions. We are unable to refund any delays due to the following: shipments that are delayed due to causes beyond Fedex's control including, but not limited to: the unavailability or refusal of a person to accept delivery of the Shipment, acts of God, natural disasters, war risks, acts of terrorism, acts of public authorities acting with actual or apparent authority, acts or omissions of customs or similar authorities, the authority of law, insufficient information provided by a customer, hazardous materials packages improperly offered for transport, the application of security regulations imposed by the government, or otherwise applicable to the Shipment, riots, strikes or other labor disputes, civil, unrest, disruptions in national or local air or ground transportation networks (including, but not limited to, Fedex's transportation network), disruption or failure of communication and information systems, and adverse weather conditions. International shipments for which the customer is responsible as the payer of any applicable duties and taxes and Delivery is delayed until payment arrangements are made. Nor CATAPULT is responsible for any shipping delays caused by the government agency. It is the receiver's responsibility to pay all duty/ taxes and broker fees associated with the shipment to the country of destination.
TYPOGRAPHICAL ERRORS: If a CATAPULT product is mistakenly listed at an incorrect price, CATAPULT reserves the right to refuse or cancel any orders placed for products listed at the incorrect price. CATAPULT reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, CATAPULT shall issue a credit to your credit card account in the amount of the incorrect price.

The customer also recognizes that because subject matter does not have to bear copyright or © ® TM or SM notice to be protected by copyright law, the absence of such notice does not necessarily assure a right to reproduce. The customer further warrants that no copyright notice has been removed from any material used in preparing the subject matter for reproduction. To support these warranties, the customer agrees to indemnify and hold us, the service provider, harmless for all liability, damages, and attorney fees that may be incurred in any legal action connected with copyright or © ® TM or SM infringement involving the work produced or provided with or without the © ® TM or SM symbols present.
TERMINATION: These terms and conditions apply to you upon you accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by CATAPULT without notice at any time, for any reason. Impersonation of others, including a CATAPULT or other licensed employee, host, or representative, as well as other members or visitors on the site, is prohibited.
DISCLAIMER: When Catapult Displays does a print for a frame that did not originate from us, we can only go by the information provided to us. Although we have done these types of prints with success, and pictures are helpful, we cannot guarantee a perfect fit or a satisfactory end result without having the frame at hand. On custom graphics that do not fit our frames, all sales will be final, no refunds, no reprints, and no returns.

We do not typically sign signature requests for third-party agreements, or any type of indemnification agreements anytime before, or during the order process, including during production, in which customers will be responsible for all portions of your order that is already in production depending on order status.
THIRD-PARTY LINKS: In an attempt to provide increased value to our visitors, CATAPULT may link to sites operated by third parties. However, even if the third party is affiliated with CATAPULT, CATAPULT has no control over these linked sites, all of which have separate privacy and data collection practices, independent of CATAPULT. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, CATAPULT seeks to protect the integrity of its website and the links placed upon it and therefore requests any feedback on not only its site, but for sites, it links to as well (including if a specific link does not work).
COLOR PROOF ACCURACY: Please note color proofs cannot match the final product 100% because proofs are created in a different way than the printed piece and the customer-supplied proofs are not calibrated to our presses.
RIGHT OF REFUSAL: We reserve the right to refuse service or products to any person or organization.
